DEADLINE THIS FRIDAY

Sobu Owners:

1. We have a buyer for the property who we are assigning your contracts to
2. The price remains the same
3. The closing date remains the same (November, 2009)
4. There is a one-page amendment which MUST BE SIGNED BY ALL 132 OWNERS NO LATER THAN THIS FRIDAYThe amendment makes the following changes:
A. Buyer is required to submit a rezoning application within 60 days of the end of his 90 day inspection period
B. We negotiated fiercely on your behalf to remove the building permit contingency (otherwise that contingency could have allowed the buyer to close well after November 2009 due to the back log in the City of Atlanta and the fact that it often takes 1+ year to obtain a building permit)

WHERE DO WE STAND:
We currently have 93 signed amendments in house. We have spoken to 16+/- owners who are sending in their signed amendments. We are working tirelessly to contact those 23 owners who have not yet signed an amendment. The buyer walks on Friday, which means the clock is ticking.

Please keep in mind – ALL CONTRACTS THAT HAVE BEEN SIGNED (LAST YEAR, ETC.) BETWEEN YOURSELF AND SOBU ASSEMBLAGE, LLC, ARE LIVE CONTRACTS FOR A CERTAIN PRICE WITH A CLOSING DATE OF NOVEMBER 2009.

JOSH WILL BE AT THE SOBU BUILDING TONIGHT FROM 5 – 9PM TO MAKE IT CONVENIENT FOR THOSE 23 OWNERS TO SIGN THEIR AMENDMENTS. There is not much else we can do on our end…we have brought the buyer and we have communicated this amazing opportunity to you via 2 meetings, emails and blog posts.

PLEASE...do not let this opportunity pass...you will lose money if you do. This building will cost us more in maintenance and repairs in the next few years than you know. Nearly every day, there is an issue somewhere in this building...including major plumbing problems, mold, the front gate, etc.
We will never sell our units for what we paid...especially if the two adjacent properties are developed and Sobu is left landlocked. It will be worth far less than what is currently being offered.
